Hansery, Inc. ("Hansery") respects the intellectual-property rights of others and expects users to do the same. This policy describes how to report claimed copyright infringement on the Hansery website and applications (the "Services") under the U.S. Digital Millennium Copyright Act ("DMCA") and how we respond. It supplements our Terms of Use.

This is especially relevant to product images, catalog content, and other materials. Vendors are responsible for ensuring they hold the rights to all catalog content and images they provide (see the Vendor Enrollment Agreement).

1. Reporting claimed infringement (takedown notice)

If you believe content on the Services infringes your copyright, send a written notice to our Designated Agent (Section 3) that includes:

  1. A physical or electronic signature of the copyright owner or authorized agent;
  2. Identification of the copyrighted work claimed to be infringed;
  3. Identification of the material claimed to be infringing and information reasonably sufficient to locate it (e.g., URL, SKU, or page);
  4. Your contact information (name, address, telephone, email);
  5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.

Incomplete notices may not be actionable. Knowingly making a material misrepresentation may subject you to liability under 17 U.S.C. § 512(f).

2. Our response

Upon receiving a valid notice, we will act expeditiously to remove or disable access to the material and, where appropriate, notify the user who provided it.

3. Designated Agent

4. Counter-notification

If your content was removed and you believe it was a mistake or misidentification, you may send a counter-notice to the Designated Agent including:

  1. Your physical or electronic signature;
  2. Identification of the removed material and its prior location;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification;
  4. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court for your district (or, if outside the U.S., any district in which Hansery may be found) and that you will accept service from the complaining party.

We may restore the material in 10–14 business days after receiving a valid counter-notice unless the complaining party notifies us that it has filed a court action.

5. Repeat infringers

We will, in appropriate circumstances, suspend or terminate the accounts of users who are repeat infringers.

6. Changes

We may update this policy and will post the revised version with a new effective date.
